Tokyo Vintage MIYABI (“MIYABI”, “we”, “us”, or “our”) is operated by Top Live Co., Ltd. (トップライブ株式会社). By accessing or using our website and services, you agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree with these terms, please do not use our website or services.

1. General Terms

1.1 Acceptance of Terms

By accessing and using the MIYABI website, you agree to be bound by these Terms of Service and our Privacy Policy.

1.2 Eligibility

You must be at least 18 years old to use this website. By using the Site, you represent that you are legally capable of entering into a binding agreement.

2. Orders and Payment

2.1 Order Acceptance

All orders placed through the MIYABI website are subject to acceptance by MIYABI. An order confirmation email does not constitute acceptance. The contract is formed only when the ordered item has been dispatched.

MIYABI reserves the right to cancel or refuse any order at its discretion, including but not limited to inventory availability or verification issues.

2.2 Pricing and Payment

All prices displayed on the Site are shown in the applicable currency and are subject to change without prior notice.

Payment must be completed at the time of purchase. Accepted payment methods include:

  • Credit Cards (Visa, MasterCard, American Express, JCB, Diners Club)
  • Apple Pay
  • Google Pay
  • Shopify Pay

PayPal is not accepted.

3. Shipping

3.1 Domestic Shipping (Japan)

All domestic shipments within Japan are delivered via Sagawa Express (佐川急便) on a cash-on-delivery (COD) basis. Shipping fees are payable by the customer upon delivery.

3.2 International Shipping

International orders are shipped via EMS (Japan Post). International shipping fees range from JPY 5,000 to JPY 10,000, depending on destination, size, and weight.

MIYABI is not responsible for delays caused by customs procedures or factors beyond our control.

4. Returns and Refunds

4.1 Return Window

Return requests must be submitted within 14 days from the order creation date. The date of first contact with MIYABI will be considered the official return request date.

4.2 Return Conditions

Returns are accepted for personal reasons provided that:

  • The item is in the same condition as received
  • No new damage, signs of use, or missing accessories
  • Return authorization is obtained prior to shipment

4.3 Fees

If the return is due to MIYABI’s responsibility (e.g. condition does not match product photos), MIYABI will cover all return-related costs.

If the return is due to the customer’s personal reason, the customer is responsible for:

  • Return shipping costs
  • 15% tax based on the product price
  • 20% restocking fee based on the product price

4.4 Refunds

Refunds will be processed within 3 business days after the returned item is received and inspected. Refunds are issued to the original payment method. Actual processing time depends on the payment provider.

5. Intellectual Property

All content on this website, including text, images, logos, and design elements, is the property of MIYABI or its licensors and is protected by applicable intellectual property laws.

Content may not be reproduced, distributed, or used for commercial purposes without prior written consent.

6. User Conduct

You agree not to misuse the website, including but not limited to:

  • Violating any applicable laws or regulations
  • Impersonating another individual or entity
  • Uploading malicious code or harmful content
  • Interfering with the operation or security of the website

7. Third-Party Services

Our website may contain links to third-party websites or services. MIYABI is not responsible for the content, policies, or practices of such third parties.

8. Limitation of Liability

MIYABI shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or services to the extent permitted by law.

MIYABI reserves the right to amend these Terms of Service at any time. Updated terms will become effective upon publication on the website.

10. Governing Law and Jurisdiction

These Terms of Service shall be governed by the laws of Japan.

The Tokyo District Court shall have exclusive jurisdiction as the court of first instance over any disputes arising from or related to these Terms of Service.
